MHL TEK, LLC vs. Nissan Motor Company et al – Federal Circuit affirms Eastern District patent summary judgment, August 10, 2011. HDBD's clients, Nissan Motor Company, Ltd. and Nissan North America, emerged victorious in an appeal to the U.S Court of Appeals for the Federal Circuit. After two years of hard-fought litigation, U.S. District Court Judge T. John Ward granted summary judgment on the eve of trial, holding that the plaintiff did not own two of the three patents at issue, and the defendants did not infringe on the third. Jeff Patterson and Jeff Cox were substantially involved in the pretrial litigation and motions leading up to the summary judgment. The defendants won the appeal in two ways: the plaintiff lost its appeal on ownership and infringement, and the defendants won their cross-appeal on the ownership of a third patent. Texas Supreme Court Reverses Appellate Court Verdict and Renders Judgment for BIC Pen Corporation – July 2011 (Austin, Texas). HDBD's client, BIC Pen Corporation, has scored a victory in an appeal to the Texas Supreme Court.  The case was previously decided in favor of the plaintiff, in spite of a compelling defense by firm partners Darrell Barger and Kyle Dreyer.  BIC lost its intermediate appeal to the Court of Appeals, then petitioned the Texas Supreme Court to review the case.  Reagan Simpson, a partner at King & Spaulding in Austin, Texas, represented BIC in their appellate case, with assistance from Mr. Barger and Mr. Dreyer. HDBD partners Deron Wade and Giovanna Bingham obtained a full defense verdict after four days of trial in a premises liability and negligent undertaking case in Hill County, Texas. BFS Retail and Commercial Operators, LLC – Defense Verdict, July 2010 (Fort Worth – Tarrant County, Texas). The plaintiff alleged an excessively worn right front ball joint on her vehicle separated causing her to run into a bridge guardrail and injure her back. Plaintiff alleged BFSR has serviced her vehicle the day of the accident, and that it should have identified the allegedly worn ball joint.
